Failure to consider risks
Steve Mason was replacing a flat roof on a domestic garage near Chelmsford in Essex on 24 June 2009 when James Waughman suffered a stroke and fell through a gap in the rafters onto the floor. He died 23 days later.
The HSE’s investigation concluded Mason had failed to consider the risks of the job and implement fall-protection measures; there were no guard-rails around the edge of the roof and he had taken no measures to prevent a fall through the roof. Mason admitted that his conduct of his undertaking had exposed others to risks to their safety (s.3(2) of the Health and Safety at Work Act 1974).
